Under Regulation 4 of the Control of Asbestos Regulations 2012, the duty holder is whoever has clear responsibility for maintenance and repair of non-domestic premises – this is usually the building owner, but it can also be a managing agent, a landlord, or an employer, depending on who actually controls the building under the terms of a lease or contract. Multiple duty holders can exist for the same building. In a multi-let commercial property, for example, the freeholder typically holds responsibility for communal areas and shared plant, while individual tenants may hold responsibility for the areas they lease and maintain themselves.
