This page contains two sets of terms:

Part A: Terms of Service

These terms apply to every quotation we issue and to all asbestos surveys, sampling, re-inspections and related services we carry out. By accepting our quotation, whether in writing, by email, by purchase order or by confirming a booking, you agree to these terms. If any term in our quotation differs from these terms, the quotation takes priority.

A1. Definitions

“We”, “us” and “our” means HSG Surveys Ltd. “You” and “the client” means the person or organisation who requests or accepts our quotation. “Domestic client” means a client acting as a consumer, for purposes outside their trade, business or profession. “Services” means the work described in our quotation. “Report” means the written survey report, sample certificate or other document we produce.

A2. Quotations

Our quotations are valid for [30] days from the date of issue. Prices are based on the information you give us about the property, including its size, number of buildings, access arrangements and the type of survey required. If the property or the scope of work turns out to be materially different from what was described, we will tell you before continuing and may revise the price.

Unless stated otherwise, prices exclude VAT, which will be added at the current rate where applicable.

A3. Booking and acceptance

A contract is formed when you accept our quotation and we confirm a survey date. We will agree the date and time with you and confirm it in writing or by email.

A4. Your responsibilities

To allow us to carry out the services safely and fully, you agree to:

  • provide safe access to all areas included in the survey, including keys, access codes and permission from any occupants or tenants;
  • give us any existing asbestos register, previous survey reports, building plans and information on the age and history of the building that you hold;
  • tell us in advance about any known hazards on site, such as unsafe structures, fragile roofs, confined spaces, live services or animals;
  • for refurbishment and demolition surveys, confirm that the areas affected are vacant (or will be vacated) and that you give permission for intrusive and destructive inspection, including lifting floor coverings, opening up walls, ceilings and boxing-in;
  • tell us clearly where the planned refurbishment or demolition works will take place, so the survey covers the right areas.

Where access cannot be gained to any area, we will record it as “no access” in the report. A return visit to survey those areas may be charged at our standard rate.

A5. Scope and limitations of surveys

All surveys are carried out in line with HSE guidance HSG264, Asbestos: The Survey Guide, by BOHS P402-qualified surveyors.

  • Management surveys are designed to locate, as far as reasonably practicable, asbestos-containing materials that could be damaged or disturbed during normal occupation and maintenance. They involve minor intrusion only and are not suitable as a basis for refurbishment or demolition work.
  • Refurbishment and demolition surveys are fully intrusive within the agreed scope. They apply only to the areas and works described to us at the time of the survey.

No survey can guarantee that every asbestos-containing material has been found. Materials may be hidden within the building structure, beneath other materials, or in areas that were inaccessible or excluded from the scope. Any such areas, and any assumptions we have made, will be stated in the report. If suspect materials are found during later works, work should stop and further advice should be sought.

We are not responsible for making good any damage necessarily caused by intrusive sampling or inspection, beyond sealing sample points with suitable material, unless agreed in the quotation.

A6. Sampling and analysis

Samples are analysed by a UKAS-accredited laboratory. Results relate only to the samples taken. Where materials are not sampled, they may be “presumed” or “strongly presumed” to contain asbestos, as allowed under HSG264, and this will be shown in the report.

A7. Reports

We aim to issue reports within [5–10] working days of the survey, subject to laboratory turnaround. Reports are issued electronically unless agreed otherwise.

The report is prepared for the client named in the quotation and for the purpose stated. Third parties may not rely on it without our written agreement. The report reflects the condition of the property on the date of the survey; asbestos-containing materials should be re-inspected regularly as part of your duty to manage.

Reports are released once payment has been received in full, unless we have agreed account terms with you in writing.

A8. Fees and payment

Payment is due on receipt of our invoice, which is issued once the survey has been carried out. The report is released when payment is received (see clause A7).

Where we have agreed account terms with you in writing, payment is due within [30] days of the invoice date, and the report will be released on issue.

For business clients, we reserve the right to charge interest and compensation on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.

A9. Cancellations and aborted visits

If you need to cancel or rearrange a survey, please give us at least [48 hours] notice. Where less notice is given, or where our surveyor attends but cannot carry out the survey because access is not available or the site is unsafe, we may charge an aborted visit fee of [£175.00 / 50% of the quoted price].

For domestic clients, this clause does not affect your right to cancel under clause A10.

A10. Domestic clients – your right to cancel

If you are a domestic client and the contract was made away from our premises or at a distance (for example by phone or email), you have the right to cancel within 14 days of the day the contract is made, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, tell us clearly by phone, email or letter using the details at the end of this page.

We will only carry out the survey within the 14-day cancellation period if you expressly ask us to. If you do, and then cancel before the survey is complete, you will pay a proportionate amount for the services provided up to the point you tell us you are cancelling. Once the services have been completed in full at your request, the right to cancel no longer applies.

Nothing in these terms affects your statutory rights as a consumer.

A11. Our liability

We carry professional indemnity and public liability insurance. We will carry out the services with reasonable skill and care.

For business clients, our total liability arising from or in connection with the services is limited to £1,000,000 in aggregate for each instruction, and we are not liable for loss of profit, loss of business, delay or any indirect or consequential loss.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

A12. Your information

We use the information you give us to provide the services and to communicate with you. Please see our Privacy Policy for details.
